DEPOSIT/PAYMENT

At the time of booking there is a non-refundable retainer deposit due within 48 hours. The retainer deposit is used towards the total cost of the session. 

Upon payment, the Photographer will reserve the time and date agreed upon by both parties. The photographer promises not to advertise availability for this same time slot to any other potential clients. 

The remaining balance which has been discussed between both parties will be due at the time of the session and is expected to be paid in Full before the session starts. 

 

Travel fees

The Client is responsible for covering a travel fee for sessions outside the City of Merced. The Clients understands and agrees to cover the costs of mileage, admission fees, parking fees, and lodging costs if necessary. 

All of which must be provided prior to appointment date.

 

CANCELLATIONS & RESCHEDULING

If the retainer deposit is not paid within 48 hours of booking, the appointment will be cancelled and  NO photography services will be fulfilled.

Once the retainer fee has been paid, Client can reschedule up to 2x as long as long as the Photographer has been notified at Minimum of 12 hours prior to appointment. The rescheduled date must be within 4 weeks of original appointment date. 

The Photographer will confirm appointment time and date via Text and Email the day prior to the agreed upon appointment date. If the appointment is NOT confirmed, the Photographer will consider the appointment Cancelled!

If the appointment must be rescheduled due to Weather Conditions it is not used as one of the Client’s options to reschedule.

 If for whatever reason the Photographer is unable to fulfill the photography services and does not offer a reschedule date, the retainer deposit will be returned to the Client in Full.

 

      LATE ARRIVALS

Any Client that is more than 15 minutes late arriving to the agreed upon appointment time will be charged a $20 late fee added to the remaining balance of the session and will have the amount of time deducted from the time allotted for their session.

If the Client is more than 30 minutes late, the appointment is considered as a No Show and the Photographer is not liable to fulfill the photography services.

 

COPYRIGHT / MODEL RELEASE

The Photographer retains copyright ownership of all images and has the right to use and publish photos taken of the Client and all subjects referred to within this agreement, including but not limited to social media, print, marketing materials, commercial art, advertising, and publishing (including electronically online). The Photographer assumes no liability for any and all claims that may arise out of the use or connection with the use of these images, including the exception of privacy or confidentiality for the Client and/or any minor child/children.

 

IMAGES & ORDERING

The Photographer will deliver Unedited Proofs of the photos to the Client via private gallery through the Photographer’s Website no later than 1 week after the date of the Session. 

The Client understands and agrees that the Proofs are the exclusive property of “In This Moment Photography By Rachelle Verley” and the Client has no right to these images except for a license to review them and select their list of images they would like retouched. In retouching the images, the Photographer only provides a natural edit. For example; Brightness, contrast, white balance, lens flare, vignettes and Black & White versions. If you would like the airbrushing of the skin, removal of scars, cuts,  blemishes, stretchmarks, you must request it from the Photographer when viewing the Unedited Proof Gallery. The Photographer will not alter the subject/subjects in any way that takes away from each of their physical appearances otherwise. The Photographer does NOT provide unnatural photoshop edits (ie: graphics, weight, bust size, etc.) We are all beautiful in the shape, size and color we are. 

The Client understands and agrees that they will not copy, screenshot, save, store, print or upload any of the Unedited Proof Photos that are in the Private Gallery.

Once the Client selects their Proofs by selecting their images and adding them to their order list, a copy of the order list will be shared with the Photographer. Please select your images and submit your orders within 7 days of receiving the Proof Gallery Link. If additional time is needed there may be an additional cost of $20 to extend or upload the Gallery again.  

When the order list is completed the Client is to notify the Photographer that the order list and/or Add Ons have been selected. 

Once the Photographer receives and confirms that the order list and/or Add Ons have been received, the Photographer promises to Upload the Finished Gallery and send the link for the client to access it via Text or Email no later than 2 weeks after the order list is received by the Photographer. The Client then has the “Shop” option available again. Please download your Gallery and submit any final orders within 7 days. The Finished Gallery expires within 1 week. To extend the Gallery or have the Photographer upload it again may have an additional fee of $20.

 

The Client understands and agrees that for a larger order (25+ images) may require 3+ weeks after the order list is received by the Photographer.

The Client understands and agrees that ______________ Full Resolution Downloadable Files and Print Release is included in the total price and any additional images and/or Add Ons have an additional fee, which is due before the Photographer agrees to fulfill the additional orders. 

 

The Client understands and agrees that the Full Resolution Downloadable Files and any other images produced by “In This Moment Photography By Rachelle Verley” shall not be for any circumstances be altered, edited, or changed in anyway including but not limited to: editing apps, filters, and social media filters.

 

The Client understands and agrees that theAdd On Print Packages, Prints and Enlargements can take up to 2 Weeks to Deliver after Photographer orders the products from the Photographer’s chosen Lab. 

Add On Wrapped Canvases, Merchandise and Photo Books take longer for delivery up to a Month after the Photographer orders the products from the Photographer’s chosen Lab.

 

The Client understands and agrees that the best quality of the Photos in forms of Print Packages, Prints, Enlargements, Wrapped Canvases, Photo Books and other Merchandise is fulfilled through the Photographer’s Online Shop Option which can be accessed through the Photographer’s Website. The Client has reviewed the Photographer’s example products and understands that the products will be of the same quality.

 

Orders can be mailed to the Client’s address for an additional mailing fee, or the Client can pick up the Order for no additional cost. 

Order pick-ups are available by appointment only. The Photographer is not responsible for any orders left past 30 days and for the Photographer to reproduce any orders the Client is responsible for additional costs before the order can be fulfilled.

Due to the nature of these Photography services, ALL sales are FINAL. Please handle your photographs with extreme care. 

THE CLIENT IS LIABLE FOR THE FOLLOWING:

-Replacement of any props and photography equipment damaged or ruined by the subject/subjects being photographed during the session. 

The Photographer is NOT liable for the following:

 

-In the event that photographic materials are damaged in processing, lost through camera or equipment malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. 

-Damages that might result from any accidents or incidents that may happen during the session.

-Damages incurred as a result of improper handling, framing, or displaying of the printed products.

-For the quality (colors, cropping, brightness, darkness) of the images which are printed or fulfilled by the Client.
